Subject: California Criminal Search
To the Group,
Can someone recommend the most efficient
way of checking criminal
records in those California counties that
are not typically covered by the major
information providers.
I understand that Merlin covers the 15 or
so most populated counties,
but that leaves quite a few counties open.
I'm looking for either an
information provider that covers the entire
state, or some other method that is both
cost-effective and efficient. I'm aware that
there are people who physically
go down to the courthouse and conduct searches,
but I'm also aware that
sometimes they go down to the courthouse
and search the cafeteria instead.

Subject: Sarbanes-Oxley Act - How does it
affect you?
Sarbanes-Oxley is a Federal statute that
came about as a result of corporate
fraud and malfeasance. The important thing
to know, for the time being, is
which businesses are affected by these new
regulations and statutes. At the
present, these statutes only concern "publicly
traded companies." So, for
most of us, we will not feel the "downside
effects" of the act; however,
there are some "upside effects"
where PIs, computer forensic specialist,
and
fraud examiners can benefit. Allow me to
explain...
Publicly traded companies are now required
to take a "proactive" approach
against internal financial fraud or face
grave consequences, e.g.,
delisting, criminal prosecution and civil
liability. Presidents, CEOs and
CFOs are no longer able to hide behind "accounting
functions" and pass the
buck to other members of the company. Presidents,
CEOs and CFOs are
responsible for establishing and maintaining
internal controls for
prevention of fraud and internal malfeasance.
Section 806 of the
Sarbanes-Oxley provides civil remedies for
any employee who is retaliated
against for whistleblowing. The act went
to the extent to read "the
employee reasonably believes fraud is occurring".
The Sarbanes Oxley Act will most likely generate
work and employment
initially for auditors, accountants, and
CPAs; however, the enormous amount
of human resources necessary to fulfill the
new positions for most publicly
traded companies should have a vacuum effect
on the available workforce
qualified to fill these positions, thus opening
up more opportunities for
PIs, fraud examiners and computer forensic
specialists. Moreover, there
will be a clear need for the services of
investigative specialists, fraud
examiners, and computer forensics specialists
once the internal auditors
determine that "malfeasance" is
discovered. Publicly traded companies can
NO LONGER sweep their dirty laundry under
the rug.
A study done by UC Berkeley in re Bristol-Myers
Squibb Securities
Litigation, 205 F.R.D. 437, 440 fn2 (2002)
found that over 93% of all
information generated in 1999 was in digital
format. All investigators
should know (or they are learning) that,
in most cases they investigate,
some of the answers may lie on the hard-drive
of a CPU somewhere. CPAs,
accountants, risk managers, and even computer
forensics specialist cannot do
it alone. At some point, they will need the
services of a well trained PI
to assist them in the investigation.
There is talk and rumbling of more regulations
spawning from the Sarbanes
Oxley Act which will be tailored more toward
private sector fraud and
malfeasance, as well as government fraud
and malfeasance. It all comes down
to accountability. The isolation of protection
as an officer, owner or
manager through the company is no longer
going to afford the limited
liability exposure that so many have enjoyed
for too long.
